Purpose of the processing

Your personal data is processed in order to send commercial communications, to carry out other marketing activities and to communicate with you.

The controller may evaluate how successful the commercial communications are, in particular by tracking e-mail opens and clicks on links contained in them, in order to improve its marketing communication.

Consent under Article 6(1)(a) of the Regulation is granted for the processing connected with the purpose described above, that is sending commercial communications, carrying out other marketing activities and communicating with you.

The controller does not carry out automated individual decision-making within the meaning of Article 22 of the Regulation.

Storage period

The controller stores your personal data for four (4) years from the day you granted your consent for this purpose, and no longer than until you withdraw your consent to the processing for this purpose.

After the consent is withdrawn, the e-mail address may be kept to a limited extent in order to record the unsubscribe and to prevent further commercial communications from being sent.

How the personal data is processed

The processing differs according to the purpose.

Communication by e-mail

The controller uses the FreeScout software for e-mail communication. The software runs on a virtual server provided by Punktero (see section 5). Tools of Anthropic or OpenAI may be used to process e-mail messages, in particular to find and formulate the right answer. These tools are also used to aggregate the content of messages — in particular to identify recurring questions, suggestions and the like.

Communication by telephone

The controller uses a VOIP exchange provided by Quantcom. Information about a telephone call is then processed automatically into the FreeScout system and may be processed as described in section 6.1.

If personal data were to be transferred to third countries outside the European Union while these tools are used, this happens solely under the conditions laid down by the Regulation, in particular on the basis of an adequacy decision or subject to appropriate safeguards under Article 46 of the Regulation.

Rights of the data subject

Under the conditions laid down by the Regulation you have the right to request access to your personal data from the controller, the right to have your personal data rectified or erased, or to have the processing restricted, the right to object to the processing of your personal data, and the right to data portability.

You have the right to withdraw the consent granted to the controller at any time. This does not affect the lawfulness of the processing carried out before the withdrawal. You can withdraw your consent by clicking the link contained in every commercial communication sent by the controller, or by sending an e-mail to the controller's address: support@punktero.com.

If you believe that the processing of your personal data has breached or is breaching the Regulation, you have, among other things, the right to lodge a complaint with a supervisory authority. The competent authority in the Czech Republic is the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), Pplk. Sochora 27, 170 00 Prague 7.

You are under no obligation to provide your personal data. Providing it is neither a statutory nor a contractual requirement, nor a requirement necessary to enter into a contract.

You have the right to object at any time to the processing of your personal data for direct marketing purposes, including profiling to the extent that it is related to such direct marketing. If you object to the processing of your personal data for direct marketing purposes, your personal data will no longer be processed for those purposes.
